Magetsi Privacy Policy
This Privacy Policy describes how Qwiktech Solutions Private Limited trading as Magetsi ("Magetsi", "we", "us") collects, uses, discloses, and protects personal data when you use the Magetsi website and related services (the "Service"). By using the Service, you agree to this Privacy Policy.
1. Key Definitions
- "Personal Data" means information relating to an identified or identifiable individual.
- "Business Customer" means a Customer using Magetsi Business; Business Bill Payments, Biller Services, or other organisational features.
- "Service Providers" means third parties who process data on Magetsi's behalf (e.g., hosting, analytics, communications, support tooling).
- "Principals" means third-party providers whose services are paid for via Magetsi (e.g., utilities, mobile network operators, billers, insurers, event organisers).
2. Data We Collect
2.1 Data you provide
- Account and profile information (e.g., email address, phone number, login credentials).
- Transaction-related information (e.g., meter numbers, beneficiary phone numbers, amounts, product selected, transaction references, and support communications).
- For Business Customers: organisational information and authorised user details needed to administer access and approvals (e.g., names, emails, phone numbers, roles).
2.2 Data collected automatically
- Usage data such as IP address, browser type, device identifiers, pages visited, time and date of access, and diagnostic logs.
- Mobile device information when accessing the Service via mobile devices (e.g., operating system, device identifiers, and diagnostic data).
2.3 Cookies and similar technologies
We use cookies and similar technologies for essential functionality, security, preferences, and analytics. You can manage cookie settings through your browser. Some features may not function if cookies are disabled.
3. How We Use Personal Data
- To provide and maintain the Service (including processing transactions and providing confirmations and receipts).
- To manage accounts and authorised access for Business Customers.
- To communicate with you about transactions, service updates, security notices, and support requests.
- To monitor, analyze, and improve the Service, including fraud prevention and security monitoring.
- To comply with legal and regulatory obligations, resolve disputes, and enforce our agreements.
- To provide marketing communications about similar products or services where you have not opted out (you can opt out at any time).
4. Business Customer Data, Confidentiality and Processing Roles
4.1 Confidentiality
Magetsi treats Business Customer account and transactional information as confidential. We do not sell Business Customer transaction data. We disclose Business Customer data only as necessary to provide the Service (including sharing with Principals and Service Providers), where required by law, or with the Business Customer's consent. We may use aggregated, de-identified information to improve our services.
4.2 Data processing roles
Where a Business Customer provides personal data of its Authorised Users, employees, or end-users to Magetsi in connection with the Service, the Business Customer is the data controller of that personal data and Magetsi processes it as a data processor on the Business Customer's behalf, to the extent necessary to provide the Service. In respect of data Magetsi collects independently (such as usage data, device information, and data collected for Magetsi's own fraud prevention and compliance purposes), Magetsi acts as an independent data controller.
4.3 Processing obligations
Where Magetsi acts as a data processor for a Business Customer, Magetsi will: (a) process the personal data only in accordance with the Business Customer's documented instructions and for the purposes of providing the Service; (b) implement appropriate technical and organisational measures to protect the personal data; (c) ensure that persons authorised to process the personal data are subject to confidentiality obligations; (d) not engage a sub-processor without prior notification to the Business Customer, and ensure sub-processors are bound by equivalent obligations; (e) assist the Business Customer in responding to data subject requests to the extent reasonably practicable; (f) notify the Business Customer without undue delay upon becoming aware of a personal data breach affecting the Business Customer's data; and (g) upon termination of the Service, return or delete the Business Customer's personal data as directed, subject to retention required by applicable law.
4.4 Data Processing Addendum
Business Customers requiring a formal Data Processing Addendum ("DPA") with additional or specific commitments may request one by contacting Magetsi. Where a DPA is executed, its terms will prevail over this section to the extent of any conflict.
5. How We Share Personal Data
We may share personal data in the following situations:
- With Principals and payment processors: to complete transactions and deliver services purchased through the platform.
- With Service Providers: to operate, secure, support, and analyze the Service (e.g., hosting, messaging, analytics, customer support tools).
- With affiliates: where needed to operate the Service, subject to appropriate safeguards.
- For business transfers: in connection with a merger, acquisition, restructuring, or sale of assets, subject to notice where required.
- For legal reasons: to comply with law, court orders, or valid requests by public authorities, or to protect rights and safety.
- With your consent: where you explicitly ask us to share information.
We do not share Business Customer transaction data with marketing partners for their independent marketing purposes without consent.
6. Data Retention
We retain personal data only as long as necessary for the purposes described in this Policy, including to meet legal, regulatory, accounting, and audit obligations, resolve disputes, and enforce agreements. Usage data is generally retained for shorter periods unless needed for security or legal requirements.
7. International Transfers
Your data may be processed in Zimbabwe and in other locations where our Service Providers operate. Where cross-border transfers occur, we take reasonable steps to ensure appropriate safeguards are in place to protect your data.
8. Security
We use commercially reasonable technical and organisational measures to protect personal data, including access controls, encryption in transit where applicable, secure authentication, monitoring, and logging. However, no method of transmission or storage is 100% secure and we cannot guarantee absolute security.
9. Your Rights and Choices
- Access and correction: request access to or correction of your personal data.
- Objection and restriction: object to or request restriction of certain processing where applicable.
- Marketing opt-out: opt out of marketing communications at any time.
- Deletion: request deletion of personal data where we are not required to retain it by law or for legitimate business purposes.
