Magetsi Terms and Conditions

1. Introduction

Welcome to Magetsi. These Terms and Conditions govern your use of our platform for bill payments and other services. By using Magetsi, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

2. Definitions

• "Magetsi" refers to Qwiktech Solutions Pvt Ltd trading as Magetsi.
• "Platform" refers to the website, mobile application, or any other digital medium provided by Magetsi.
• "Customer" refers to any individual or entity using Magetsi’s services.
• "Principals" refers to the service providers, such as mobile network operators, insurance companies, utility companies, event organizers, and promoters.

Magetsi provides a platform for the payment of various bills and services on behalf of our principals. The products and services available on our platform are provided on an agency basis. These products include but are not limited to:

4.1. Account Creation: Users may be required to create an account to access certain features of the platform.
4.2. Account Security: Users are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account.

5. Payment Terms

5.1. Payment Methods: Magetsi accepts various payment methods, including EcoCash, local bank transfers, and international cards such as VISA and Mastercard.
5.2. Payment Processing: All payments are processed securely, and users are provided with a transaction reference for their records.

6. Refund Policy

6.1. No Refunds: Magetsi does not issue refunds for completed transactions, as the services are provided on behalf of our principals.
6.2. Exceptions: Refunds may be issued in cases of failed recharges, account top-ups, or account payments where the customer has successfully made a payment but did not receive the service.
6.3. Refund Requests: To request a refund, customers must contact Magetsi’s customer support team and provide the necessary transaction details.

7. Specific Terms

Certain products may have specific terms and conditions displayed on the product page. These specific terms take precedence over the general terms in case of any conflict.

8. Intellectual Property

All content on the Magetsi platform, including text, graphics, logos, and software, is the property of Magetsi or its content suppliers and is protected by intellectual property laws.

9. Privacy Policy

Magetsi respects the privacy of its users. Our Privacy Policy, which explains how we collect, use, and disclose information, is available on our platform.

10. Indemnification

10.1. Customer Indemnity: Customers agree to indemnify, defend, and hold harmless Magetsi, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with their access to or use of the platform, or their violation of these Terms and Conditions.

11. Limitation of Liability

Magetsi is not liable for any direct, indirect, incidental, or consequential damages arising from the use of our platform or the services provided. Magetsi’s liability is limited to the amount paid by the customer for the specific transaction in question.

12. Dispute Resolution

12.1. Initial Resolution: Customers agree to contact Magetsi’s customer support team to attempt to resolve any disputes or issues related to transactions before initiating a dispute claim with their bank or any other external body.
12.2. Dispute Claims: If a customer initiates a dispute claim with their bank without first contacting Magetsi for resolution, Magetsi reserves the right to charge the customer any costs incurred in handling the dispute, including administrative fees.
12.3. Binding Arbitration: Any unresolved disputes between the customer and Magetsi that cannot be settled through initial resolution efforts shall be referred to and finally resolved by arbitration in Zimbabwe in accordance with the Arbitration Act (Chapter 7:15). The arbitration shall be conducted in English.

13. Fraudulent Payments

13.1. Zero Tolerance: Magetsi has a zero-tolerance policy for fraudulent activities. Any customer found to be engaging in fraudulent payment activities will be subject to account suspension or termination and will be reported to the relevant authorities.
13.2. Investigation and Cooperation: Magetsi reserves the right to investigate any suspicious transactions and to cooperate with law enforcement authorities in the investigation of any alleged criminal activity.
13.3. Chargebacks: In the event of a chargeback or payment reversal due to suspected fraud, Magetsi reserves the right to reclaim any benefits, rewards, or points issued to the customer in connection with the fraudulent transaction.
13.4. Liability: Customers shall be liable for all costs, expenses, and losses incurred by Magetsi as a result of any fraudulent payment activities, including legal fees and any penalties imposed by payment processors or banks.

14. Amendments

Magetsi reserves the right to amend these Terms and Conditions at any time. Users will be notified of any significant changes, and continued use of the platform constitutes acceptance of the revised terms.

15. Governing Law

These Terms and Conditions are governed by the laws of Zimbabwe. Any disputes arising from the use of Magetsi’s services shall be subject to the jurisdiction of the courts in Zimbabwe.

16. Entire Agreement

These Terms and Conditions constitute the entire agreement between the user and Magetsi regarding the use of the platform and supersede any prior agreements or understandings, whether written or oral.
